Why is Failure to Diagnose Cancer a Medical Malpractice Claim?

Georgia Medical Malpractice Lawyers on Common Types of Negligence Cases

When a doctor fails to identify cancer, this allows the cancer to continue growing, which can lead to a worse prognosis for the patient. In this video, medical malpractice attorney Kathy McArthur explains how lawyers can pursue a medical negligence claim against doctors who fail to diagnose breast cancer. We all hear that early detection of cancer is the key, and it really is. They have tried to put out literature to say that sometimes early detection doesn’t matter, but there are a lot of cancers, such as breast cancer and colon cancer, that are very treatable and curable but only if they are found early. So, if you have a lump in your breast or a lesion on your cervix and a physician doesn’t do a biopsy, doesn’t send you to a surgeon to have a biopsy done and just says, “Well, let’s just watch this…” and they watch it for six months, they watch it for a year or even just say, “You are too young to have cancer.” Therefore, they just don’t think about it being cancer. Well, if it is cancer, which young people get cancer too, so in my opinion when you have a lump or a lesion, it’s cancer until proven otherwise and that is borne out by physicians as well that that’s their opinion too.

But if the cancer is delayed in diagnosis by a year, it significantly alters the outcome in terms of what treatment people have to receive. You know, sometimes breast cancer can be managed. The bigger issue is not removal of a piece of your body; it’s survival from the cancer. So, the chances of surviving cancer go way down if you have more than a six month delay in diagnosis. And if you have more than a year delay in diagnosis, unless it’s a very slow growing cancer, it can be catastrophic.
