Do Most Personal Injury Cases Settle Out of Court?

Personal injury cases settle out of court for a number of reasons. At the McArthur Law Firm, our team of trial lawyers has a reputation for taking a case to a jury. Insurance companies know we are not afraid to go to court, which actually makes them more inclined to settle our clients’ cases for full and fair compensation. In this video, attorney Kathy McArthur explains more about why some personal injury cases settle and some have to go to trial.

Things have changed with all this television advertising by attorneys, who say there’s something they’re not and who never try a case. So, it’s made it real difficult for people to know who is the attorney I should hire, but it’s a very important decision what they should ask is: What is your experience in handling cases like this? Can you tell me about some of the cases you’ve handled? Have you taken a case like this and actually gone to a jury verdict, meaning go completely through a trial and get a jury verdict? Tell me about some of those, because that’s going to separate the people that are true civil trial lawyers from those who prepare the case and then they settle every case. If you always settle all your cases and you don’t go to a jury verdict ever, the insurance companies know that. So, they pay those lawyers less money because they know that those lawyers will not take it to a jury if they’re not reasonable with them. We don’t try all of our cases, but we’ve gone to jury verdicts sufficient numbers of times. We’ve beaten those offers in every single car wreck case we’ve ever tried. We’ve gotten more money. Well, why don’t you try them all? Well, you can’t. They’re not that unreasonable in all cases, but in the ones we’ve decided they got to go to a jury verdict, we’ve beaten the offer every time. So we have a track record of that, so the insurance companies, they pay us more money than they pay other people who don’t have the credibility that we do who settle all their cases. And you won’t believe this, but so few lawyers have ever tried a jury case to a jury verdict. You would not believe it, it’s less than five percent of lawyers. Ninety-five percent of lawyers don’t go to trial and don’t go to court.
