Georgia state law defines wrongful death as the death of an individual caused by the “negligent, reckless, intentional, or criminal” acts of another person or entity. Under the law, only certain individuals can recover for the loss of a loved one.

Under the Georgia Wrongful Death Act, ownership of a wrongful death claim is vested as follows:

  1. The spouse of the decedent;
  2. If there is no spouse, then to the decedent’s children;
  3. If there is no spouse or children, then to the living parent of the decedent; and
  4. If there is no spouse, children or living parent, then to the administrator of the decedent’s estate.

Individuals have the right to recover “the full value of the life of the decedent without deducting for any of the necessary or personal expenses of the decedent had he lived.” The “full value” can include funeral expenses, past medical bills, lost income, loss of companionship, emotional damages as well as pain and suffering. Of course, there is no “full value” to a human life. The law is not perfect. However, this is the only way our justice system is able to assist families after an unexpected loss of life due to negligence of another individual or company.
