A Full Investigation is the Best Thing for Your Personal Injury Case
Have you ever heard the old saying that patience is a virtue? Well, it can definitely apply to personal injury cases. Some companies will try to undercut the value of a case by offering an early settlement, but accepting that settlement can be a mistake. Often these companies don’t offer you what your case is worth. How do you know? A full investigation into all the relevant issues is necessary. Personal injury attorneys who have a proven track record of successful verdicts and settlements are a good place to start. Kathy McArthur explains just how settlements can be used against victims in court.
It’s amazing what you find out if you don’t settle in the first six month. It’s amazing, the terrible things they’ve done and no wonder they want to settle early. But are they going to settle for what the case is worth? No, they’re going to settle for what, quote, they typically pay in a case like this, which is ten percent of what ultimately the case may be worth. They just want to buy people off with a quick settlement for a lot less than what the case is worth and not have any lawyer get involved who is somebody who looks at this and says, wait a minute. We may settle later but first we’re going to find out, we’re going to get all the documents. We’re going to get cellphone records. We’re going to get the health records of your driver. We’re going to find out if there have been violations. We’re going to know what he did before he was out driving that day. We’re going to look at his logbook, see if he has violated the hours of service rules and if he’s done that a lot in the past. There are records of those things. We’re going to look at the whole picture. Not just what happened this day. We’re going to figure out why it happened this day, because why it happened this day is a product of what’s happened on all the prior days. And you don’t know that unless you dig, unless you fight them, and unless you make them give it to you. And most law firms don’t do that. They just want to settle early and quickly. They look at clients as like lambs. You know they’re innocent. They come in thinking that you’re going to treat them fairly and that you’re going to be, you know, their fighter, and that you’re going to do good things and that you’re going to have their best interest at heart and that’s, yes. Here that’s true. In a lot of firms it’s not that they’re bad people, it’s that they convince themselves that a quick settlement is the best thing and it’s not the best thing.
